Article 1 - Purpose
The present conditions govern the sales by NUVILINE of food and nutrition products.
Article 2 - Prices
The prices of our products are indicated in euros inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and exclusive of processing and shipping costs.
If you order from a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of NUVILINE. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to enquire about these aspects with your local authorities.
All orders, whatever their origin, are payable in euros.
NUVILINE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.
The products remain the property of NUVILINE until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

For payments by cheque only, you can place an order by telephone on +33 (0)6 17 43 95 from Monday to Friday and from 8.30am to 5.30pm.
Contractual information is presented in French and will be confirmed at the latest when your order is validated.
NUVILINE reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
Article 4 - Validation of your order
Any order placed on the www.nuviline.fr website implies acceptance of these General Terms and Conditions. Any confirmation of an order implies your full acceptance of these General Terms and Conditions of Sale, without exception or reservation.
All of the data supplied and the recorded confirmation will constitute proof of the transaction.
You declare that you are fully aware of them.
Confirmation of the order will be deemed to constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the e-mail address used to confirm your order.
Article 5 - Payment
Validating your order implies that you are obliged to pay the price indicated.
Payment for your purchases is made by credit card using the Crédit Agricole payment system called E-transactions.
The card is debited immediately when the order is placed. In the case of split deliveries, only the products dispatched are debited.
Article 6 - Withdrawal
In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your decision or pay any penalty.
Returns must be in their original condition and complete (packaging, accessories, instructions). In this case, you are liable. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
You are responsible for the cost of returning the goods.
In the event of exercise of the right of retractation, company SLIMPACK will carry out the refunding of the versed sums, within 14 days according to the notification of your request and via the same means of payment that that used at the time of the order.

Article 7 - Mediation

Article 8 - Availability
Our products are offered as long as they are visible on the www.nuviline.fr website and within the limits of available stocks. For products not in stock, our offers are valid subject to availability from our suppliers.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.
In addition, the www.nuviline.fr website is not intended to sell its products in large quantities. Consequently, NUVILINE reserves the right to refuse orders of 100 identical items.
Article 9 - Delivery
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page (time not guaranteed but indicative and generally observed - working days).
In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences for the delivery time indicated.
In accordance with legal provisions, in the event of late delivery, you may cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code. If, in the meantime, you receive the product, we will reimburse you and the delivery costs in accordance with Article L 138-3 of the French Consumer Code.
In the case of deliveries by a carrier, NUVILINE cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several proposed appointments.
Article 10 - Warranty
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for in articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.
All claims, requests for exchange or reimbursement must be made by e-mail or post within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of proof.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 11 - Liability
The products offered comply with current French legislation. NUVILINE cannot be held responsible in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities about the possibility of importing or using the products or services you intend to order.
Furthermore, NUVILINE shall not be held liable for any damage resulting from improper use of the product purchased.
Finally, NUVILINE may not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.
Article 12 - Applicable law in the event of disputes
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
